Terms and Conditions

This document outlines the Terms and Conditions (the “Terms and Conditions”) that form the basis of the contract (the “Contract”) between you, the traveler (hereinafter “traveler,” “you,” “your”), and E.E.F.Y. TRAVEL LLC, a limited liability company.

EEFY Travel is a full-service travel agency dedicated to designing and arranging unique and memorable experiences. We work with couples, families, small groups, solo, and business travelers to plan various types of travel, including beach vacations, city escapes, cruises, safaris, and business trips. We are excited to serve you and make your next trip as memorable and stress-free as possible.

Acceptance of Terms and Conditions

We draw your attention to these Terms and Conditions, which, along with, documents, correspondence, and the terms and conditions of our Suppliers (as defined below), form the basis of the Contract with you.

Before making a booking with us, you must ensure that you have read and understood these Terms and Conditions (and ask any questions you may have). Please be aware that these Terms and Conditions contain waivers of liability as well as a waiver of class action, and venue selection and notice clauses.

By asking us to confirm your booking, you are accepting all the Terms and Conditions laid out below and acknowledging that you have read and agree with the terms of this Contract.

Group Bookings

If you are making a booking as a group, the leader of the group is responsible for sharing these Terms and Conditions with all members of the group and is financially responsible for the booking. We will not be liable for a group leader’s failure to share these Terms and Conditions with all travelers in their group.

Your Warranties

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you, or members of your group is true and correct.

Violations by You

You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable travel-related product or service.

Changes to These Terms and Conditions

E.E.F.Y TRAVEL reserves the right, in our sole discretion, to change these Terms and Conditions at any time. Upon making changes, we will notify you via the email address you provide to us at booking. The current terms will apply to your booking. You must therefore be familiar with the terms in effect at the time you book. Your continued use of our services, including continuing to use or maintain any bookings after notice of any changes to the terms and conditions, constitutes your consent to the changes.

Scope of Service and Agency

E.E.F.Y TRAVEL acts only as a retail travel agent for the traveler in acquiring transportation, hotel accommodations, cruises, sightseeing, and other privileges or services for the traveler’s benefit.

E.E.F.Y TRAVEL does not provide, own, or control the travel services and products that are or may be provided as part of your trip, such as flights, accommodations, cruise, rental cars, packages, or travel insurance (the “Travel Products”). The Travel Products are owned, controlled, or made available by vetted third parties (the “Suppliers”) such as airlines, hotels, cruise lines, and tour operators. The Suppliers are responsible for the Travel Products.

The Supplier’s terms and privacy policies apply to your booking, so you must agree to and understand those terms. Your interaction with any Supplier is at your own risk. E.E.F.Y Travel does not bear any responsibility should anything go wrong with your booking or during your travel.

EEFY Travel shall not be responsible for any loss, accident, injury, delay, defect, omission, or irregularity which may occur or be occasioned, whether by reason of any act, negligence, or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith.

Booking and Payment

Fees

As travel planning takes time and effort, E.E.F.Y TRAVEL provides expertise and attention to detail. Our Consultation, Planning, and Travel Management Fee, if any, for your trip is based on those factors and is non-refundable even if you cancel your trip or decide not to book, unless otherwise stated in the “Cancellation by Traveler” section below.

Payment Schedule

Upon booking, we will provide you with instructions for payments and all due dates. You must make all payments in full, on time, and in accordance with the Supplier’s requirements. If you are booking within 60 days of the departure date, the Supplier may require full payment at the time of booking confirmation.

If full payment is not received by the due date on your invoice, we reserve the right to cancel your travel and apply the cancellation charges set out in the cancellation section below. Failure to make a payment may result in the cancellation of your travel. In such a case, this would be considered a cancellation by you, and the cancellation terms and fees as described below would be in effect. Traveler understands that discounted fares typically involve restrictions, and changing any aspect of the travel arrangements may result in the payment of additional money.

Documentation Review

Please review all documents, including the cancellation policies and terms and conditions of the Suppliers, carefully and promptly, as we will not be responsible for any errors. It is your responsibility to review all travel documentation and alert us as soon as possible of any corrections.

Deposits

Deposits are typically NON-REFUNDABLE unless stated otherwise in the terms and conditions of the Supplier.

Price and Rate Changes

The price listed in your proposal will be based on known costs at the date of issue of the proposal. All prices we advertise are quoted and payable in the currency in which they were booked and are accurate as of the date issued, but we reserve the right to change any of those prices from time to time as the Suppliers adjust the prices.

Prices that include costs for fuel and local taxes that are estimated at the date of issue are subject to change. At the time of booking confirmation, we will provide you with an invoice reflecting the current price and particular inclusions.

Price Changes After Confirmation

Upon payment of your deposit and confirmation of your booking, your price will be locked in with the exception of any increases or decreases resulting from fuel, airport charges, scheduled airfares and other transport charges which form part of your contract with the transport provider, dues or taxes payable locally, currency fluctuations and government action, any other airline surcharges, taxes, port fees, or fees payable for services. We reserve the right to add a supplement to your travel prices should these additional fees apply to our booking, until we receive your final payment. If your booking is impacted by the adjusted fees, we reserve the right to increase or decrease the price of your travel and will forward a new invoice reflecting any changes made. After final payment, your price is locked in.

Cancellation and Changes

Cancellation by Traveler

Cancellation of travel must be made in writing and is effective from the date we receive the written notification.

Our Consultation, Planning, and Travel Management Fee, will not be refundable under the following circumstances:

  1. A full refund will be given if work has not commenced and prior to the Trip Consultation call.
  2. After the initial consultation and planning call has taken place, should the client wish to cancel, a 50% refund will be issued.
  3. Once a quote or suggested itinerary has been sent, the Consultation, Planning, and Travel Management Fee is non-refundable.

All Suppliers have their own cancellation policies, which apply to your booking. Upon receipt of your cancellation request, we will contact the Suppliers for any applicable refunds subject to the Supplier’s terms and conditions. If you are entitled to a refund, please note that the Supplier is responsible for this refund, not E.E.F.Y TRAVEL. Suppliers may choose to provide a travel voucher or credit in lieu of a refund. We are not responsible under any circumstances for a Supplier’s failure to pay a refund, or for Supplier bankruptcy or insolvency.

If the reason for cancellation is covered under the terms of your travel protection plan, you may be able to reclaim these charges, for this reason, we strongly encourage the purchase of a travel protection plan, including additional “cancel for any reason” coverage.

Changes and Cancellation by the Supplier

We will inform you as soon as reasonably possible if a Supplier needs to make a significant change to your confirmed booking or to cancel. We will also liaise between you and the Supplier in relation to any alternative arrangements offered by the Supplier, but we will have no further liability to you.

If, between planning time and/or during actual travel, circumstances require changes, E.E.F.Y TRAVEL and its Suppliers reserve the right to cancel or vary any itinerary and substitute components of any trip, including but not limited to hotels and accommodations of comparable quality. These changes will not be considered material changes and will not be considered cause for cancellation by the traveler. Normal cancellation penalties still apply to the trip that has been changed.

Travel Protection

It is the traveler’s responsibility to protect their purchases. For this reason, Travel Protection Coverage, including additional “cancel for any reason” coverage, is strongly recommended. Such plans should cover Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage insurance.

E.E.F.Y TRAVEL is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. If you have any questions about your travel protection, call your insurer or insurance agent or broker.

Declining to purchase an adequate travel protection plan could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs, or expenses incurred. If you choose to travel without adequate coverage, E.E.F.Y TRAVEL will not be liable for any of your losses howsoever arising, for which a trip protection plan coverage would otherwise have been available.

COVID-19 Release of Liability/ Hurricanes or Unforeseen Circumstances 

By booking a trip at this time, you acknowledge the highly contagious nature of COVID-19 or any other diseases, viruses, etc. and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 (or other diseases, viruses, etc.) by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, which cannot be controlled or eliminated by E.E.F.Y TRAVEL.

Travel Requirements

You acknowledge that due to the uncertainty of travel at this time, your trip may be postponed or cancelled, or changes may be made to itineraries for which there may be no refund. You may also be required to quarantine upon arrival, have a vaccination, or show proof of negative testing. You are responsible for understanding these requirements and must not rely on E.E.F.Y TRAVEL to provide these details.

You agree that due to uncertainty caused by COVID-19 (or other diseases, viruses, etc.), E.E.F.Y TRAVEL has strongly encouraged the purchase of travel protection coverage, including cancel for any reason coverage if and when available, and that should you fail to purchase travel protection coverage, E.E.F.Y TRAVEL shall not be liable for any losses howsoever arising.

Release and Hold Harmless

You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives, and next of kin (collectively, the “Releasors”), HEREBY RELEASE, AND HOLD HARMLESS E.E.F.Y TRAVEL, its owners, members, agents, and/or employees, and Suppliers (collectively, the “Releasees”), from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part, to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH, OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID-19 or any other infectious diseases, viruses, etc., WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph shall survive any termination or cancellation of this Contract.

Non-Responsibility and Assumption of Risk

E.E.F.Y TRAVEL and its Representatives are not responsible or liable for any loss, injury, or damage to any traveler or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of E.E.F.Y TRAVEL.

Assumption of Risk/Waiver

Traveler is aware that travel may involve inherent risks, including, but not limited to, risks of injury or death from motor vehicles collisions, criminal acts, exposure to the elements, your own negligence and/or the negligence of others, accidents or illness occurring in remote places where there are no available medical services, and the risk of infection, illness, and death.

Traveler hereby accepts and assumes full responsibility for any and all risks of illness, injury, or death and of the negligence of E.E.F.Y TRAVEL and agrees to and shall hold harmless and fully release E.E.F.Y TRAVEL, and its employees, shareholders, agents, and representatives (“Representatives”) from any and all claims associated with the trip, including any claims of third-party negligence and/or the negligence of E.E.F.Y TRAVEL and/or its Representatives, and traveler hereby covenants not to sue E.E.F.Y TRAVEL and/or its Representatives for any such claims or join any lawsuit or action that is suing E.E.F.Y TRAVEL.

Indemnification

Traveler agrees to and shall indemnify and hold harmless EEFY Travel and its Representatives from any expenses, losses, liabilities, damages, judgments, settlements, and costs (collectively, “damages”) involved with or incurred by EEFY Travel or its Representatives with respect to any claims, lawsuits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) traveler’s breach or violation, or threatened breach or violation, of this Contract and (ii) any damage caused by traveler while participating in the trip.

Destination and Documentation

It is the responsibility of each traveler to obtain and carry a valid passport, visa(s), inoculations, and all other documents required by applicable government regulations. E.E.F.Y TRAVEL bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.

E.E.F.Y TRAVEL  strongly recommends that you consider that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry.

If you are denied access to a country or a Supplier due to a criminal conviction or any other reason related to your personal documentation or status, E.E.F.Y TRAVEL shall not be liable for any losses, expenses, or refunds to you or anyone in your group.

These Terms & Conditions (“Terms”) govern your access to and use of the E.E.F.Y TRAVEL LLC website (the “Site”) and any services provided by E.E.F.Y TRAVEL LLC (“we,” “us,” “our,” “E.E.F.Y Travel”) in connection with travel planning, booking, and related services (collectively, the “Services”). By accessing or using the Site or booking through our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site or Services.

1. Scope; Independent Agent Role

1.1 Agency Role
E.E.F.Y Travel acts as an intermediary or agent between you (“you,” “client,” “traveler”) and third-party travel service providers (e.g. airlines, hotels, tour operators, car rental companies, ground transport, excursion operators) (collectively, “Suppliers”). We do not operate flights, hotels, cruises, or tours ourselves (unless explicitly stated). All bookings and travel arrangements are subject to the terms, conditions, and limitations imposed by the relevant Suppliers.

1.2 Supplier Terms Apply
Your use of the Services is subject not only to these Terms, but also to the terms, rules, and conditions of each Supplier whose services you purchase. By booking through us, you accept and agree that you will comply with those third-party Supplier terms.

2. Booking, Payment & Deposit

2.1 Quotation and Confirmation
Any quotes, itineraries, or proposals we provide are valid for a limited time (specified in the quote). We reserve the right to correct errors or omissions, and to decline or cancel bookings (even after confirmation) in certain circumstances.

2.2 Deposit / Payment Schedule

  • A non-refundable, non-transferable deposit (amount to be specified) is required to secure certain arrangements. Deposit may be refundable where travel insurance is purchased.
  • The full balance is due by a deadline we specify (e.g. 30, 60, or 90 days before travel). Guaranteed balance of payment required 60 days prior to departure. For select products, full payment may be required earlier than this and will be stated on the booking invoice. If the balance is not paid by the stipulated date, the right is reserved to cancel the booking(s) without further notice and without refund of deposit.
  • If full payment is not received by the due date, we may cancel your reservations, and cancellation penalties may apply.

2.3 Methods of Payment
We accept payment via paypal, zelle, and credit card authorizations If a payment method fails or is reversed, we may suspend or cancel your booking.

2.4 Taxes, Fees & Surcharges
Quoted prices may not include all taxes, service fees, surcharges, fuel charges, or other costs imposed by Suppliers, local governments, or transit authorities. You are responsible for any additional costs, unless otherwise stated in writing.

2.5 Currency & Exchange Rates
Pricing is generally in USD. If any component is in a foreign currency, the rate of exchange used at the time of conversion will apply.

3. Cancellations, Changes & Refunds

3.1 Your Cancellation / Changes
If you need to cancel or change a booking, you must notify us in writing as soon as possible. Any cancellation or change is subject to:

  • Supplier policies and penalties
  • Our service fees (non-refundable, non-transferable)
  • Additional costs or penalties imposed by Suppliers or third parties
  • Cancellations received more than 60 days prior to departure will incur loss of the non-refundable deposit as specified above.
  • Other specific supplier and airline cancellation penalties may apply in addition to cancellation and amendment fees charged by E.E.F.Y TRAVEL LLC.
  •  There will be no refund for unused land arrangements after departure.
  •  All cancellations required in writing, and must be acknowledged by E.E.F.Y TRAVEL LLC.

3.2 Supplier Cancellation / Changes
If a Supplier cancels or materially changes a travel service (e.g. schedule change, route change, hotel overbooking), we will endeavor to notify you and may assist in obtaining alternatives or refunds. However, we are not responsible for Supplier defaults, and any compensation is subject to Supplier terms. 

3.3 Refunds & Credits
Refunds (if applicable) will be processed after reconciliation with the relevant Supplier. Any refunds are contingent on what the Supplier allows. We may deduct service fees or cancellation penalties before issuing refunds. 

3.4 No-Show / Unused Services
No refund or credit is due for services you do not use (e.g. missed flights, unused hotel nights), unless the Supplier agrees otherwise in writing.

4. Travel Documents & Client Responsibilities

4.1 Passports, Visas, & Entry Requirements
You are solely responsible for verifying and obtaining proper travel documents (passports, visas, vaccinations, immunizations, health certificates, entry/exit permits) well in advance of travel. We do not guarantee that you will be permitted into (or depart from) any country. If you are denied entry, refused boarding, or otherwise penalized by authorities, you bear all costs and consequences. A passport valid for six months beyond the date of travel is required for entry into all countries. Visas may be required for certain countries; please inquire for details. Please check with your agent at time of booking if visas are still required for these or other countries. If you are not travelling on an American or Canadian passport, it is imperative that you also check visa requirements for all of the destinations you will be travelling to or transiting through. Ultimately, it is your responsibility to ensure you have the correct documentation. 

4.2 Health, Insurance & Safety
We make no representations about the health, safety, or security of any destination, and you travel at your own risk. We strongly recommend Travel Insurance for all travel. Travel Insurance offers protection for unforeseen trip cancellation. Accidents and illness prior to or during travel can affect not only your trip, but may result in high medical expenses and extra costs, as can weather and flight delays. 

4.3 Health, Insurance & Safety Continued Any such expenses and costs are the travellers responsibility, and they shall not be entitled to any refund from E.E.F.Y TRAVEL LLC, of monies paid, for any unused or lost travel arrangements. Travel Insurance protects against such costs, subject to the insurer’s policy conditions. Some countries now require proof of adequate travel medical insurance before allowing entry. E.E.F.Y TRAVEL LLC and its subsidiaries will not be responsible for any loss or costs incurred for events that are beyond our control, and will apply any fees and charges in accordance with our Booking Conditions. We recommend Travel Insurance always; never travel without it!

4.4 Accuracy of Information
You must provide correct and complete traveler information (names, dates of birth, gender, identification numbers) exactly as they appear on your travel documents. We are not liable for costs incurred due to inaccurate or late information, or failure to provide required documents.

4.5 Behavior & Compliance with Laws
You must comply with all local laws, Supplier rules, and codes of conduct while traveling. You assume responsibility for all acts, omissions, or behavior during the trip.

4.6 Living Standards And Practices At The Destination: These may differ from those found in your country of Origin. The standards and conditions there with respect to the provision of utilities, services and accommodation may also differ from those found in your country of origin. 

5. Service Fees & Changes by E.E.F.Y Travel

5.1 Service Fees
In addition to Supplier charges, we may charge service, consulting, planning, or processing fees. These will be disclosed to you in writing prior to booking. These fees are non-refundable once services are rendered or arrangements have been made.

5.2 Amendments by Us
If we need to make a material change to your itinerary (e.g. change in date, route, major component), we will notify you and offer alternative options. If no acceptable alternative is available, you may cancel your booking and seek a refund (subject to Supplier terms and our service fees).

5.3 Limit on Our Liability
Our liability is strictly limited as set forth in Section 7 (Limitation of Liability). We act in good faith but cannot guarantee every aspect of every booking.

6. Intellectual Property & Use of Site

6.1 Ownership
All content on the Site—text, graphics, logos, images, software, designs, etc.—is owned by or licensed to E.E.F.Y TRAVEL.

6.2 Limited License
You may view, download, or print pages from the Site for your personal, noncommercial use, provided you retain all notices and disclaimers. You may not modify, publish, transmit, create derivative works, or use content for commercial purposes without our prior written consent.

6.3 User Conduct & Prohibited Use
You agree not to use the Site or Services to:

  • Violate any law or third-party rights
  • Post or transmit harmful, defamatory, obscene, or abusive content
  • Interfere with or disrupt the Site’s operation
  • Use automated means, bots, scrapers, or other methods to extract data
  • Impersonate any person or entity, or misrepresent affiliation

We reserve the right to suspend or terminate access for violation of these prohibitions.

7. Disclaimers, Limitations, and Indemnification

7.1 Disclaimer of Warranties
To the fullest extent permitted by law, the Site and Services are provided “as is” and “as available,” without warranties of any kind (express or implied), including warranties of merchantability, fitness for a particular purpose, or non-infringement. E.E.F.Y Travel does not warrant that the Site will be error-free, uninterrupted, secure, or free from viruses.

7.2 Limitation of Liability
In no event shall E.E.F.Y Travel, its officers, employees, agents, or affiliates be liable for indirect, incidental, special, punitive, or consequential damages (including loss of profit, data, or goodwill), even if advised of the possibility of such damages. Our total aggregate liability arising from or relating to these Terms or Services shall not exceed the amount you paid us (excluding supplier costs) for the specific booking giving rise to the claim.

7.3 Indemnification
You agree to indemnify, defend, and hold harmless E.E.F.Y TRAVEL and its officers, employees, and agents from any claim, demand, loss, liability, damages, or costs (including legal fees) arising out of your breach of these Terms, your negligence, or your misuse of the Site or Services.

7.4 Operator’s Responsibility: E.E.F.Y TRAVEL LLC. and/or its agents, act only as agents for the client in all matters pertaining to travel. They assume no responsibility nor liability in connection with the service of any train, vessel, carriage, aircraft, motor or other conveyances which may be used, either wholly or in part, in the performance of its duty to the passenger; neither will it be responsible for any act, error, or omission, or any injury, loss, accident, delay or irregularity which may be occasioned by reason of any defect in any vehicle or through the neglect or default of any company or person engaged in conveying the passenger; or for any hotel proprietor, or hotel service, or for any other person engaged in carrying out the purpose for which tickets or coupons are issued. In the event that it becomes necessary or advisable for the comfort or well being of the passengers, or for any reason whatsoever, to alter the itinerary or arrangements, such alterations may be made without penalty to the operators. Additional expenses, if any, shall be borne by the passengers, conversely refund will be made to the passengers if any saving is effected thereby. The Airlines concerned are not to be held responsible for any act, omission, or event, during the time passengers are not on board their planes or conveyance. The passage contract in use by the Airlines concerned, when issued, shall constitute the sole contract between the Airlines and the purchaser of these tours and/or passenger. The right is reserved to withdraw any or all tours should conditions warrant, also to decline to accept or retain any passengers as members of the tours. 

8. Governing Law, Disputes & Arbitration

8.1 Governing Law
These Terms shall be governed by and construed under the laws of the specified State without regard to its conflict of laws rules.

8.2 Dispute Resolution / Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be finally resolved by binding arbitration (unless prohibited by applicable law). The arbitrator’s decision shall be final and binding.

8.3 Class Action Waiver
You agree that any arbitration shall be on an individual basis. You waive any right to participate in class actions or class arbitrations.

8.4 Statute of Limitations
Any claim you bring against us must be filed within 3 Months after the cause of action arises, or it will be barred.

9. Modifications to Terms & Interruptions

9.1 Changes to Terms
We reserve the right to amend or revise these Terms at any time. The updated version will be posted on the Site, and the “Last Updated” date will change. Your continued use after changes means you accept the new Terms.

9.2 Service Interruptions
We may suspend, restrict, or discontinue the Site or Services (in whole or part) at any time for maintenance, security, updates, or for any reason, with or without notice. We are not liable for any loss or damage resulting from such interruptions.

9.3 Force Majeure

We shall not be liable for any claims, losses, damages, costs, expenses, delays or loss of enjoyment, of any nature or kind whatsoever, resulting from events beyond our or a supplier’s reasonable control, including but not limited to acts of God, strikes, lockouts or other labour disputes or disruptions, wars, blockades, insurrections, riots, earthquakes, weather conditions, floods or acts or restraints imposed by government authorities. 

10. Severability & Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. Failure by us to enforce any right or provision does not waive that right or provision.

11. Miscellaneous

11.1 Third-Party Beneficiaries
